This Privacy Policy explains how EveryWill, Inc., a Delaware corporation (“EveryWill”, “we”, “us”), collects, uses, and shares personal information when you use everywill.com, our will-creation platform, and our related tools, websites, and support channels (together, the “Services”). It applies to the Services in the United States. By using the Services, you agree to the practices described here; if you do not agree, please do not use the Services.

The information we collect

Information you provide.

To create your will, we ask for information at each step, including but not limited to: your legal name, date of birth, address, and email address; gender; your marital status and, if you have one, your spouse’s or partner’s name, date of birth, and email address; your children’s names and dates of birth, and your pets’ names; the people you appoint — executors, guardians, and pet caretakers — and, for some of them, their email addresses; your beneficiaries and how you divide your estate, including any specific gifts of money, real estate, or personal items, the charities you choose, and any messages you attach to gifts; your funeral wishes; and, if you opt in to sharing your gift details with charities, an optional phone number. If you contact support, we collect what you send us. We do not ask for Social Security numbers or government identifiers.

Information about other people.

Much of a will is information about others — a partner, children, executors, guardians, beneficiaries. When you provide it, you are responsible for being entitled to do so, and we handle it under this policy for the purpose of creating and managing your documents. Where you authorize it in the flow, we send notifications to people you name (for example, an email letting your partner know they have been named in your will — the email does not include your will). If you use our invite feature, we use the email addresses you enter to send a one-time invitation on your behalf and do not use them for other marketing.

Information collected automatically.

Like most websites, we and our providers collect device and usage information — IP address, browser and device type, approximate location (city/state from IP), pages visited, and how you interact with the Services — using cookies and similar technologies. We use PostHog for product analytics. You can control cookies through your browser and the choices described below.

A note on sensitive information.

Some of what a will contains can reveal sensitive things about you — for example, funeral wishes or charity choices may reflect religious beliefs, and your family details reflect your relationships. We use this information only to provide the Services (to create your documents and operate the features you choose) and do not use or disclose it for purposes that would require a separate “right to limit” under state privacy laws.

How we use information

We use personal information to: provide the Services — generate your Documents, operate your account, and deliver the features you select; communicate with you about your account and the Services; send marketing emails, which you can opt out of at any time via the unsubscribe link; facilitate charitable gift designations in accordance with your choices; analyze and improve the Services; keep the Services secure and prevent fraud and misuse; and comply with law.

De-identified and aggregated data.

We create de-identified and aggregated information — such as statistics about gifts, estates, and platform use — and may use and share it for any lawful purpose, including with the organizations listed in the Services. We maintain such data in de-identified form and will not attempt to re-identify it, except as permitted by law to test that protection.

Artificial intelligence.

We may use artificial-intelligence tools, including from third-party providers acting as our service providers, to help operate, support, and improve the Services. We do not allow these providers to use your personal information to train their models.

How we share information

Service providers. We share information with vendors that help us operate — hosting and infrastructure, email delivery and marketing communications, analytics, and support tooling — under contracts limiting their use of it to providing services to us.

Charities you choose — only if you opt in.

If you include a charitable gift, we ask at the end of the flow whether you want to share your gift details with the charities you named. If you choose Yes, we share with those organizations (and only those organizations): your name, email address, mailing address, and date of birth, your phone number if you chose to add it, and details of your gift, such as its type and amount, after your will is completed. Organizations receiving this information use it for their own purposes, such as gift administration, planned giving, and thanking you. If you choose No, your gift stays anonymous to the charity: we may share only de-identified or aggregated gift information, which does not identify you. You can change your choice at any time by logging in and updating your selection.

Compensated services.

Organizations may provide compensation to EveryWill in connection with platform services, including access to the gift details that donors choose to share with them. For the avoidance of doubt, we do not share your personal contact details with organizations unless you selected Yes on the gift-details sharing step. Where the law of your state treats this as a “sale” or “sharing” of personal information, you can opt out at any time as described in Your Privacy Choices, and we honor the Global Privacy Control.

Advertising partners.

We use advertising and measurement tools from partners such as Meta and Google, which may collect identifiers and usage information through cookies and pixels on the Services to measure and improve our advertising and to show you more relevant ads elsewhere. Some state laws treat this as “sharing” or “targeted advertising”; you can opt out as described below.

Our corporate group.

EveryWill is operated with the support of personnel employed by our Australian parent company, who may access personal information from Australia to run the Services under the commitments in this policy. Information may also be disclosed within our corporate group, in connection with a merger, acquisition, financing, or sale of assets, and where required by law or legal process, or to protect the rights, safety, or property of EveryWill, our users, or others.

Cookies, analytics, and advertising choices

We use necessary cookies to run the Services, analytics cookies to understand use, and advertising pixels as described above. You can manage cookies in your browser; industry opt-outs for interest-based advertising are available from the Network Advertising Initiative and the Digital Advertising Alliance. These choices apply per browser and per device.

Your Privacy Choices

You can control how your information is used and shared:

• Opt out of the disclosures that state law treats as “sales,” “sharing,” or targeted advertising using the “Your Privacy Choices” link in the footer of our website.

•  Turn on the Global Privacy Control in your browser — a browser setting or extension that automatically signals your opt-out preference to every website you visit — and we will honor it as an opt-out for that browser where the law requires. We do not respond to the older “Do Not Track” setting, which never became an enforceable standard.

•  Change your charity-sharing selection at any time by logging in and updating your selection.

• Unsubscribe from marketing emails using the link in any marketing email; service and account messages continue while you have an account.

•Delete your account from within the platform.

Your privacy rights

Depending on where you live, you may have the right to: know and access the personal information we hold about you and receive a copy in a portable format; correct inaccurate information; delete personal information; opt out of “sales,” “sharing,” targeted advertising, and certain profiling; limit the use of sensitive personal information (as noted above, we do not use sensitive information in ways that require this); and not be discriminated against for exercising these rights.

To exercise rights, use your account tools or email contact.us@everywill.com. We verify requests against the email on your account and may ask for more information where the request is sensitive; authorized agents must provide written proof of authority. We respond within the time your state’s law requires (generally 45 days, with a permitted extension). If we decline a request, you may appeal by replying to our response, and where your state provides it, you may also contact your state Attorney General.

California

This section supplements the policy for California residents under the CCPA. In the last 12 months we may have collected these categories of personal information: identifiers (name, email, address, phone, IP address); protected classifications (age, marital status); commercial information (gift designations and platform activity); internet or network activity (usage data); approximate geolocation (from IP address); and the contents of your Documents and communications. We collect them from you, your devices, and our partners’ referral links, for the purposes described above, and disclose them to the recipients described above. The charity-sharing described above (because organizations may compensate us) and the advertising pixels described above may be “sales” or “sharing” under the CCPA; you may opt out via Your Privacy Choices, and we honor the GPC. We do not knowingly sell or share the personal information of anyone under 16. We do not use sensitive personal information for purposes requiring a right to limit. Our notice at collection is provided at the point of collection and links here. California’s “Shine the Light” law also lets you request information about disclosures to third parties for their direct marketing; we do not make such disclosures, but you may ask at contact.us@everywill.com.

Other states; Nevada

Residents of other states with comprehensive privacy laws (including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Maryland, Minnesota, Tennessee, Indiana, Kentucky, and Rhode Island, as their laws take effect) have the rights described above, subject to their laws’ conditions. Nevada residents: we do not sell personal information as defined by Nevada law; you may submit a request at contact.us@everywill.com.

Retention

We keep personal information while your account is active and as needed to provide the Services, meet legal obligations, resolve disputes, and enforce agreements. How long we keep particular information depends on its nature and sensitivity, the purposes it serves, and legal requirements. When information is no longer needed, we delete or de-identify it. If you delete your account, we handle your information accordingly — download any Documents you want to keep first.

Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest and access controls limiting access to those who need it to operate the Services. No system is completely secure, and we cannot guarantee the security of information; if a breach affecting you requires notice, we will provide it as the law requires.

Children

The Services are for adults 18 and over, and we do not knowingly collect personal information from children through the Services. Information about your children that you enter (such as names and dates of birth for guardianship provisions) is used only to create your documents and operate your account.

Where your information is stored

Your information is stored on servers located in the United States. Personnel of our Australian parent company, Gathered Here Pty Ltd (ABN 36 617 115 885), may access it from Australia to operate and support the Services; privacy laws there may differ from those where you live, and we handle personal information under this policy wherever it is accessed or processed.

Changes to this policy

We will post updates here with a new effective date.
